1. Introduction and acceptance

1.1 These Terms & Conditions (“Terms”) apply to all tours, coaching sessions, skills clinics, events, races, and related activities (“Activities”) provided by MTB Detour Pty Ltd (“MTB Detour”, “we”, “us”, “our”).

1.2 By making a booking, participating in an Activity, or attending an event delivered by MTB Detour, you confirm that you have read, understood, and agree to be bound by these Terms.

1.3 If you do not agree to these Terms, you must not book or participate in any Activity.

 

2. Eligibility and participation

2.1 Participation in Activities requires an appropriate level of physical fitness, riding skill, and personal capability.

2.2 You must accurately disclose all relevant medical, physical, psychological, or behavioural conditions that may affect your safety or the safety of others.

2.3 MTB Detour reserves the right to refuse or discontinue participation where safety concerns arise, including where information has been withheld or misrepresented.

 

3. Assumption of risk

3.1 You acknowledge that mountain biking and outdoor adventure activities involve inherent risks, including but not limited to falls, collisions, equipment failure, environmental hazards, weather exposure, and remoteness.

3.2 You voluntarily participate in Activities with full knowledge of these risks.

 

3.3 A full Waiver & Assumption of Risk Policy applies to all Activities and forms part of these Terms.

 

4. Safety, equipment, and conduct

4.1 You must comply with all safety instructions issued by MTB Detour staff, guides, coaches, or event officials.

 

4.2 Mandatory safety equipment, including approved helmets and any additional required protective equipment, must be worn or used as directed.

4.3 You are responsible for ensuring your equipment is fit for purpose and in safe working condition unless equipment is supplied by MTB Detour.

4.4 Unsafe behaviour, failure to follow instructions, or conduct that places others at risk may result in immediate removal from an Activity without refund.

 

5. Medical treatment and emergencies

5.1 You authorise MTB Detour to administer first aid and arrange emergency medical treatment where required.

5.2 You accept responsibility for any costs associated with medical treatment, evacuation, or emergency response, unless otherwise required by law.

5.3 Emergency decisions may be made without prior consultation where delay would increase risk.

 

6. Weather, environment, and force majeure

6.1 Activities may be modified, postponed, or cancelled due to weather conditions, environmental factors, access restrictions, or events beyond MTB Detour’s reasonable control.

6.2 Such events may include severe weather, natural disasters, regulatory closures, public health directives, or other force majeure events.

6.3 Refunds, credits, or rescheduling in these circumstances are managed in accordance with the Cancellation & Refund Policy.

 

7. Bookings, payments, and cancellations

7.1 A booking is confirmed once payment is received and accepted.

7.2 Cancellation, refund, and rescheduling conditions are governed by the Cancellation & Refund Policy, which forms part of these Terms.

7.3 Failure to attend an Activity at the scheduled time may be treated as a no-show, with no entitlement to refund.

 

8. Minors and guardians

8.1 Participants under 18 years of age (“Minors”) may only participate where a lawful parent or guardian has provided informed consent.

8.2 Some Activities may permit unaccompanied Minors subject to supervision, skill, and safety requirements.

8.3 All Minor participation is governed by the Minor Participation & Guardian Authority Policy and the Child Safety & Protection Policy.

 

9. Media, photography, and privacy

9.1 MTB Detour may capture photographs or video during Activities for operational, safety, or promotional purposes.

9.2 Use of personal information is governed by the Privacy Policy, which complies with the Privacy Act 1988 (Cth).

9.3 Media involving Minors is subject to additional consent requirements.

 

10. Environment, land, and cultural respect

10.1 Participants must act responsibly and respectfully toward the environment, trail infrastructure, land managers, and Traditional Owners.

10.2 Environmental protection and cultural heritage obligations apply to all Activities.

 

11. Complaints and dispute resolution

11.1 MTB Detour is committed to fair, timely, and transparent handling of complaints.

11.2 Complaints and disputes are managed in accordance with the Complaints, Feedback & Dispute Resolution Policy.

 

12. Limitation of liability

12.1 To the extent permitted by law, MTB Detour is not liable for loss, damage, delay, inconvenience, or injury arising from participation in Activities.

12.2 Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law.

 

13. Incorporation of policies

13.1 These Terms incorporate by reference all MTB Detour policies published on our website, including but not limited to policies relating to safety, risk, medical disclosure, minors, environmental protection, cultural heritage, media, privacy, cancellations, complaints, and data management.

13.2 Those policies form part of these Terms as if set out in full.

 

14. Governing law

14.1 These Terms are governed by the laws of Queensland, Australia.

14.2 Where Activities are conducted outside Queensland or Australia, local laws may also apply.

 

15. Acceptance

15.1 By booking or participating in an Activity with MTB Detour Pty Ltd, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
