EMERGENCY RESPONSE & PARTICIPANT COST RESPONSIBILITY POLICY

1. Purpose
1.1 This Emergency Response & Participant Cost Responsibility Policy (“Policy”) establishes the procedures, authority, responsibilities, and financial obligations that apply during emergencies occurring in the course of tours, coaching sessions, races, events, and related activities (“Activities”) delivered by MTB Detour Pty Ltd (“the Operator”).
1.2 This Policy ensures that Participants understand:
(a) the Operator’s authority during emergencies;
(b) their own obligations and expected conduct;
(c) the inherent limitations of remote-area adventure activities;
(d) the costs for which Participants may be responsible.

This Policy must be read with the Terms of Participation, Participant Waiver & Assumption of Risk, and all other Operator Policies.
2. Scope
2.1 This Policy applies to:
(a) all Participants, including minors;
(b) all Guardians providing consent for minors;
(c) all staff, Guides, contractors, and volunteers;
(d) all Activities conducted by the Operator in Queensland, interstate, or internationally.
3. Definitions
3.1 “Emergency” means any actual or potential injury, illness, incident, hazard, or threatening event requiring urgent management.
3.2 “Evacuation” means transport of a Participant from the field to a safer location or medical facility by foot, bike, stretcher, vehicle, ambulance, helicopter, or other means.
3.3 “First Responders” includes paramedics, police, fire services, SES, or any emergency agency.
3.4 “Guardian” means a legal guardian consenting on behalf of a minor.
4. Operator Authority During Emergencies
4.1 During an emergency, the Operator (through Guides or staff) has full authority to:
(a) stop or modify the Activity;
(b) direct Participants to safety;
(c) initiate first aid or medical assistance;
(d) call emergency services;
(e) initiate evacuation procedures;
(f) manage group safety and movement;
(g) determine whether a Participant may continue.
4.2 Participants must comply immediately with all instructions.
4.3 Refusal to follow emergency instructions may result in removal from the Activity without refund.
5. Limitations of Remote-Area Emergency Response
5.1 Participants acknowledge that Activities may occur in environments where:
(a) emergency services are significantly delayed;
(b) communication networks are unreliable or unavailable;
(c) helicopter access is weather-dependent;
(d) terrain limits vehicle access;
(e) extraction may require long periods on foot.
5.2 These limitations may increase the severity of injuries or delay treatment.
6. First Aid and Medical Consent
6.1 Participants consent to:
(a) first aid provided by Guides or trained personnel;
(b) CPR, immobilisation, bandaging, bleeding control, or medical interventions as necessary;
(c) emergency medical care by external responders;
(d) sharing relevant medical information with emergency personnel.
6.2 If the Participant is a Minor, the Guardian provides consent on their behalf.
7. Evacuation Authority
7.1 The Operator may determine the most appropriate evacuation method, including:
(a) assisted walking;
(b) supported riding;
(c) stretcher extraction;
(d) 4WD or shuttle retrieval;
(e) ambulance transport;
(f) helicopter evacuation.
7.2 Guide decisions regarding evacuation pathways are final.
8. Participant Financial Responsibility
8.1 Participants are financially responsible for all costs associated with:
(a) ambulance transport;
(b) helicopter evacuation;
(c) 4WD or specialised extraction;
(d) medical treatment before, during, and after evacuation;
(e) private rescue services;
(f) staff time required to support the evacuation;
(g) recovery or retrieval of equipment left behind.
8.2 These costs may be substantial, and the Participant acknowledges they may not be covered by insurance.
9. Equipment Retrieval After Incident or Evacuation
9.1 If Equipment must be left behind due to an emergency:
(a) retrieval will be attempted when safe;
(b) retrieval may require additional labour or transport costs;
(c) the Participant may be charged for retrieval expenses.
10. Group Safety Prioritisation
10.1 In emergencies, the Operator prioritises the safety of the entire group.
10.2 Guides may:
(a) hold the group in safe areas;
(b) divert Participants via alternate routes;
(c) shorten or cancel the Activity.
10.3 Participants impacted by such changes are not entitled to refunds.
11. Responsibilities of Participants During Emergencies
11.1 Participants must:
(a) remain calm;
(b) follow instructions;
(c) assist where safe and appropriate;
(d) notify the Guide of symptoms or hazards;
(e) avoid interfering with emergency management.
12. Responsibilities of Guardians for Minors
12.1 Guardians consent to emergency treatment and evacuation for Minors.
12.2 Guardians acknowledge that:
(a) Minors may be separated from the group temporarily;
(b) communication with the Guardian may occur only when safe;
(c) emergency services may be contacted before the Guardian if delay increases risk.
13. Limitations of Liability
13.1 The Operator is not liable for:
(a) delays in emergency response;
(b) conditions or actions of emergency services;
(c) worsening of injuries due to terrain or remoteness;
(d) Participant refusal to follow safety instructions.
13.2 This Policy does not exclude mandatory protections under Australian Consumer Law.
14. Jurisdiction
14.1 This Policy is governed by the laws of Queensland.
14.2 Where Activities occur outside Queensland, local emergency laws apply in addition.
15. Acceptance Statement
“By participating in activities delivered by MTB Detour Pty Ltd (ACN 693 200 289), I confirm that I have read, understood, and agree to the Emergency Response & Participant Cost Responsibility Policy, including my financial responsibility for evacuation and medical costs.”
