MEDICAL, FITNESS & HEALTH DISCLOSURE POLICY

1. Purpose

1.1 This Medical, Fitness & Health Disclosure Policy (“Policy”) ensures that all Participants engaging in tours, coaching programs, skills sessions, races, events, and associated mountain biking activities (“Activities”) delivered by MTB Detour Pty Ltd (“the Operator”) provide accurate and complete medical, health, and fitness information necessary for safe participation.

1.2 This Policy exists to reduce risks associated with physical exertion, environmental exposure, terrain difficulty, and emergency response.

1.3 This Policy must be read together with the Terms of Participation, Participant Waiver & Assumption of Risk, and all other Operator Policies.

2. Scope

2.1 This Policy applies to:

(a) all Participants;

(b) all Guardians of participating minors;

(c) all Activities delivered by the Operator.

2.2 Additional health disclosures may be required for advanced coaching, high-risk terrain, multi-day tours, or events in remote environments.

3. Definitions

3.1 “Participant” means any individual engaging in an Activity.

3.2 “Minor” means a Participant under 18 years of age.

3.3 “Guardian” means a parent or legal guardian authorising a Minor’s participation.

3.4 “Medical Condition” includes any physical, psychological, or neurological condition that may affect participation.

3.5 “Emergency Contact” means the person nominated for notification during an incident.

4. Participant Health Warranties

4.1 Participants warrant that they:

(a) are physically able to participate safely;

(b) possess sufficient fitness for the Activity;

(c) are free from medical conditions that could impair participation OR they have disclosed such conditions fully;

(d) will not participate if ill, fatigued, or unfit;

(e) will update the Operator of any changes to health prior to the Activity.

5. Mandatory Medical Disclosure

5.1 Participants must disclose any relevant Medical Conditions, including but not limited to:

(a) asthma, respiratory issues, or shortness of breath;

(b) heart conditions or high blood pressure;

(c) diabetes or blood sugar disorders;

(d) epilepsy, seizures, or fainting episodes;

(e) allergies (including anaphylaxis);

(f) musculoskeletal injuries or chronic pain;

(g) recent surgery or ongoing rehabilitation;

(h) mental health concerns affecting safety or decision-making;

(i) heat sensitivity or cold intolerance;

(j) medication requirements.

5.2 Failure to disclose may:

(a) endanger the Participant or others;

(b) void insurance coverage;

(c) result in removal from the Activity;

(d) constitute negligence on the part of the Participant or Guardian.

6. Medication & Medical Devices

6.1 Participants must carry necessary medications including:

(a) inhalers;

(b) EpiPens;

(c) glucose tablets or insulin;

(d) prescribed medications essential for ongoing conditions.

6.2 Participants must inform Guides of:

(a) location of medications;

(b) medication requirements;

(c) any conditions requiring monitoring.

6.3 Medications must be self-administered unless the Participant is a Minor and specific instructions are provided by the Guardian.

7. Pre-Existing Injuries or Conditions

7.1 Participants with pre-existing injuries must:

(a) disclose the nature of the injury;

(b) confirm clearance to participate from a medical professional if required;

(c) accept full responsibility for exacerbation of known conditions;

(d) avoid pushing beyond medically safe limits.

8. Fitness Requirements

8.1 Participants must possess fitness levels appropriate to:

(a) ride duration;

(b) terrain difficulty;

(c) elevation gain;

(d) weather conditions;

(e) technical riding demands.

8.2 Guides may assess Participant capability and adjust group structure or remove Participants if safety is compromised.

9. Symptoms and Illness During Activities

9.1 Participants experiencing symptoms including:

(a) dizziness;

(b) chest pain;

(c) heat stress;

(d) shortness of breath;

(e) nausea;

(f) confusion;

(g) severe fatigue

must notify Guides immediately.

9.2 Guides may require the Participant to:

(a) rest;

(b) cease participation;

(c) divert to an easier route;

(d) undergo first-aid assessment.

10. Heat, Weather & Environmental Exposure

10.1 Participants must disclose if they are susceptible to:

(a) heat exhaustion;

(b) dehydration;

(c) heat stroke;

(d) cold intolerance;

(e) sun sensitivity;

(f) asthma triggered by environmental factors.

10.2 The Operator may require additional hydration, PPE, rest breaks, or route changes based on environmental conditions.

11. Emergency Contact Requirements

11.1 Participants must nominate a valid Emergency Contact.

11.2 For Minors, the Emergency Contact must be the Guardian unless approved otherwise.

12. Minors and Guardian Responsibilities

12.1 Guardians must:

(a) complete all medical disclosures for the Minor;

(b) provide accurate and up-to-date information;

(c) ensure the Minor carries required medications;

(d) understand the Minor’s health needs and limitations;

(e) authorise emergency treatment in accordance with applicable Policies.

12.2 Guardians accept liability for failure to disclose relevant information.

13. Confidentiality & Privacy

13.1 All medical information is held in accordance with:

(a) the Privacy Policy;

(b) Australian Privacy Principles;

(c) child safety legislation.

13.2 Medical information is only shared with staff on a need-to-know basis.

14. Non-Disclosure & Consequences

14.1 Failure to disclose relevant medical information may result in:

(a) removal from the Activity;

(b) refusal of future bookings;

(c) denied insurance claims;

(d) personal liability for injuries or incidents.

14.2 Knowingly providing false information constitutes misconduct.

15. Jurisdiction

15.1 This Policy is governed by the laws of Queensland.

15.2 Local laws apply where Activities occur outside Queensland.

16. Acceptance Statement

“By participating in activities delivered by MTB Detour Pty Ltd (ACN 693 200 289), I confirm that I have read, understood, and will comply with the Medical, Fitness & Health Disclosure Policy, and that all medical information provided is accurate and complete.”
