PHOTOGRAPHY, MEDIA & DIGITAL CONTENT POLICY

1. Purpose

1.1 This Photography, Media & Digital Content Policy (“Policy”) governs the capture, use, storage, publication, and distribution of photographs, video, audio, and digital media (“Media Content”) taken during tours, coaching sessions, races, events, or associated activities (“Activities”) delivered by MTB Detour Pty Ltd (“the Operator”).

1.2 This Policy ensures that Media Content is captured and used responsibly, ethically, lawfully, and in a way that protects Participant privacy and child safety.

1.3 This Policy must be read in conjunction with the Privacy Policy, Data Retention & Records Management Policy, and the Child Safety & Protection Policy.

2. Scope

2.1 This Policy applies to:

(a) all Participants;

(b) all Minors and their Guardians;

(c) all staff, Guides, coaches, and volunteers;

(d) all third-party photographers and videographers engaged by the Operator.

3. Definition

3.1 “Media Content” means any photograph, video, audio, or digital recording.

3.2 “Guardian” means a lawful parent or legal guardian of a Minor.

3.3 “Personal Information” has the same meaning as in the Privacy Act 1988 (Cth).

3.4 “Sensitive Content” refers to images involving Minors, injuries, private conversations, or culturally significant locations.

4. Operator Photography & Filming

4.1 The Operator may capture Media Content during Activities for operational, safety, educational, and promotional purposes.

4.2 Media Content may be used for:

(a) social media posts;

(b) promotional materials;

(c) website galleries;

(d) training or coaching resources;

(e) incident documentation;

(f) internal reporting.

4.3 Participants may opt-out of promotional use, except where Media Content is required for:

(a) safety;

(b) incident reporting;

(c) insurance claims;

(d) regulatory compliance.

5. Participant Consent

5.1 By participating in an Activity, adult Participants consent to:

(a) being photographed or filmed;

(b) reasonable use of Media Content for promotional purposes;

(c) internal use for safety or operational purposes.

5.2 Participants may withdraw promotional consent at any time by email to info@mtbdetour.com.

6. Media Content Involving Minors

6.1 Media Content featuring Minors requires explicit Guardian consent.

6.2 Where consent is granted:

(a) Minor images must avoid identifying information;

(b) sensitive contexts (injuries, distress, bathroom areas) must not be photographed;

(c) images must be respectful and appropriate.

6.3 No Media Content of Minors may be used for promotion without Guardian approval.

6.4 A Guardian may withdraw consent at any time, noting:

(a) previously published material cannot always be removed;

(b) future use will cease immediately.

7. Restrictions on Photography by Participants

7.1 Participants must not photograph or film:

(a) Minors without Guardian permission;

(b) private conversations;

(c) incidents or injuries unless instructed;

(d) culturally sensitive or restricted sites;

(e) staff in private or inappropriate contexts.

7.2 Drones are prohibited unless explicitly authorised by the Operator and land managers.

8. Professional Photographers & Third Parties

8.1 Third-party photographers engaged for events or tours must:

(a) comply with this Policy;

(b) hold a Working With Children Blue Card when photographing Minors;

(c) comply with cultural and land access restrictions;

(d) deliver content to the Operator for review before public release if required.

9. Participant Access to Media Content

9.1 Participants may access or purchase Media Content created during Activities where the Operator offers such services.

9.2 Media Content remains the property of the Operator unless otherwise agreed.

10. Intellectual Property & Copyright

10.1 All Media Content captured by the Operator or its contractors is owned by MTB Detour Pty Ltd.

10.2 Participants must not:

(a) edit Media Content in a misleading or harmful way;

(b) remove Operator branding or watermarks;

(c) claim ownership of Operator-captured Media Content.

10.3 Participants retain ownership of Media Content they personally capture, subject to other restrictions in this Policy.

11. Safety & Incident Photography

11.1 Media Content captured for safety or incident management:

(a) is used internally only;

(b) may be provided to emergency services, insurers, or legal authorities;

(c) must not be published publicly.

11.2 Participants must follow Guide instructions regarding photography during incidents.

12. Cultural Restrictions

12.1 Photography of culturally sensitive or restricted areas is prohibited unless permitted by Traditional Owners or land managers.

12.2 Guides will advise Participants where restrictions apply.

13. Privacy & Data Storage

13.1 Media Content is stored and retained in accordance with:

(a) the Privacy Policy;

(b) the Data Retention & Records Management Policy;

(c) applicable privacy legislation.

13.2 Sensitive Content involving Minors is stored with heightened security.

14. Removal Requests

14.1 Participants may request removal of Media Content involving themselves.

14.2 The Operator will remove content where reasonable and technically possible.

14.3 The Operator is not responsible for third-party re-publication beyond its control.

15. Unacceptable Use of Media Content

15.1 Participants must not use Media Content to:

(a) harass, bully, or embarrass others;

(b) misrepresent the Operator;

(c) promote unsafe behaviour;

(d) breach cultural, environmental, or land access rules.

15.2 Misuse may result in:

(a) removal from Activities;

(b) legal action;

(c) cancellation of future bookings.

16. Jurisdiction

16.1 This Policy is governed by the laws of Queensland.

16.2 Local photography laws may apply in other jurisdictions.

17. Acceptance Statement

“By participating in activities delivered by MTB Detour Pty Ltd (ACN 693 200 289), I acknowledge that I have read, understood, and agree to the Photography, Media & Digital Content Policy.”
