FORCE MAJEURE & GLOBAL WEATHER POLICY

1. Purpose

1.1 This Force Majeure & Global Weather Policy (“Policy”) establishes the rights, responsibilities, and procedures governing delays, modifications, suspensions, and cancellations of tours, coaching sessions, races, events, and related activities (“Activities”) delivered by MTB Detour Pty Ltd (“the Operator”) due to weather, environmental conditions, or events beyond the Operator’s control.

1.2 This Policy protects Participant safety and operational viability when conditions arise that make Activity delivery unsafe, unlawful, or impossible.

1.3 This Policy must be read with the Terms of Participation, Cancellation & Refund Policy, and all other Operator Policies.

2. Scope

2.1 This Policy applies to all:

(a) Participants;

(b) Guardians of participating minors;

(c) staff, Guides, contractors, and volunteers;

(d) Activities conducted in Queensland, interstate, or internationally.

3. Definitions

3.1 “Force Majeure Event” means any event beyond the reasonable control of the Operator, whether foreseeable or unforeseeable.

3.2 “Weather Event” means any environmental or meteorological condition affecting safety or feasibility.

3.3 “Regulatory Closure” includes closures mandated by government, land managers, councils, or Traditional Owners.

4. Weather Events

4.1 The Operator may modify, postpone, or cancel Activities in response to Weather Events including:

(a) thunderstorms, lightning, or hail;

(b) high winds or wind gusts;

(c) heavy rain, flooding, or saturated trails;

(d) extreme heat or humidity;

(e) extreme cold or hypothermia risk;

(f) fog or low visibility;

(g) smoke haze, air pollution, or reduced air quality;

(h) landslides, falling debris, or unstable terrain.

4.2 The Operator has absolute discretion in determining whether conditions are safe.

5. Force Majeure Events

5.1 A Force Majeure Event includes, but is not limited to:

(a) natural disasters (cyclone, hurricane, bushfire, flood, earthquake, volcanic activity);

(b) pandemics, epidemics, or public health restrictions;

(c) war, terrorism, civil unrest, or riot;

(d) national or international travel bans;

(e) government directives affecting access or operations;

(f) transport shutdowns or major road closures;

(g) industrial action or workforce shortages;

(h) major ICT or utility failures beyond the Operator’s control;

(i) any event making Activity delivery unsafe or unlawful.

6. Land Access Restrictions & Regulatory Closures

6.1 Activities may be modified or cancelled due to:

(a) National Park or State Forest closures;

(b) Council trail closures or maintenance orders;

(c) private land access restrictions;

(d) wildlife alerts or environmental protection orders;

(e) cultural heritage directives issued by Traditional Owners.

6.2 The Operator must comply with all such directives.

7. Operator Rights in Response to Weather or Force Majeure

7.1 The Operator may:

(a) modify Activity routes;

(b) adjust pacing or duration;

(c) change locations;

(d) delay start times;

(e) reschedule the Activity;

(f) cancel the Activity.

7.2 Participants must follow all revised instructions.

7.3 No refund is payable where an Activity is modified for safety reasons.

8. Refunds & Rescheduling

8.1 Where cancellation is caused by a Weather Event:

(a) Participants may be offered rescheduling;

(b) refunds will be considered in line with the Cancellation & Refund Policy.

8.2 Where cancellation is caused by a Force Majeure Event:

(a) refunds may not be available if costs have already been incurred;

(b) a credit or reschedule may be offered where feasible.

8.3 Where conditions are declared safe by the Operator but the Participant chooses not to attend, no refund applies.

9. Participant Responsibilities Related to Weather

9.1 Participants must:

(a) prepare for variable weather conditions;

(b) bring appropriate equipment and PPE;

(c) comply with modified routes and instructions;

(d) notify Guides of symptoms related to heat, cold, or weather stress.

9.2 Participants acknowledge that weather conditions may change rapidly.

10. Events & Races

10.1 For competitive events, the Operator or Race Director may:

(a) modify course stages;

(b) neutralise sections;

(c) adjust start times;

(d) shorten or cancel the event.

10.2 Event-specific rules may apply.

10.3 AusCycling or governing-body requirements may override aspects of this Policy.

11. Limitations of Liability

11.1 The Operator is not liable for:

(a) cancellations due to weather or Force Majeure;

(b) Participant travel or accommodation expenses;

(c) disappointment, inconvenience, or business losses;

(d) environmental or access conditions outside its control.

11.2 Mandatory consumer guarantees under the Australian Consumer Law remain unaffected.

12. Jurisdiction

12.1 This Policy is governed by the laws of Queensland.

12.2 Local laws apply for Activities conducted in other jurisdictions.

13. Acceptance Statement

“By participating in activities delivered by MTB Detour Pty Ltd (ACN 693 200 289), I confirm that I have read, understood, and agree to the Force Majeure & Global Weather Policy.”
